Terms of Service
Welcome to TrueAcre. These Terms of Service (“Terms”) govern your use of the TrueAcre marketplace, mobile applications, and related services (collectively, the “Services”) operated by TrueAcre Technologies Pvt. Ltd. (CIN: U72200TG2024PTC123456), a company incorporated under the Companies Act, 2013, with its registered office at Hyderabad, Telangana, India.
§1Acceptance of terms
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services. By creating an account, listing or inquiring about a property, or transacting on TrueAcre, you represent that you are at least 18 years of age and competent to enter into a binding contract under Indian law.
§2Eligibility & accounts
You must be an Indian resident (or NRI/OCI with applicable agricultural land purchase rights under FEMA) to use the Services for property transactions. You agree to:
- Provide accurate, current, and complete information.
- Maintain the security of your password and accept all risks of unauthorized access.
- Promptly update us of any changes to your information.
- Be responsible for all activities under your account.
§3Verification process
TrueAcre verifies listed properties through a 16-document checklist and field inspection. The verification badge indicates that our team has reviewed the listed documents and field conditions. However, verification is an opinion, not a guarantee of title. We strongly recommend you conduct your own legal review before purchase.
What it does not cover: hidden tax dues, pending mutation, undisclosed encumbrances filed in the last 30 days, or any future regulatory changes affecting the land.
§4Listings & content
Sellers retain ownership of listing content. By listing a property, you grant TrueAcre a non-exclusive, worldwide, royalty-free license to display, edit, and promote the listing across the Services and marketing channels for the duration of the listing.
You represent that you have the legal right to sell the listed property, that all information provided is true and accurate, and that the property is free of undisclosed encumbrances.
§5Fees & payments
Listing a property is free under the Basic plan. The “Plus” plan costs ₹ 9,999 per listing. A commission of 2.0% of the final sale value (or 1.5% for Agent Pro subscribers) is payable to TrueAcre upon successful closing. All fees are exclusive of applicable GST. §6TrueAcre Escrow
TrueAcre operates a Trust & Retention Account (TRA) with ICICI Bank under RBI license #RBI/UCB/2024/8842. Buyer deposits are held in this escrow account in a fiduciary capacity until the conditions of release — typically, registration of the sale deed at the relevant sub-registrar — are satisfied.
Escrow funds are bankruptcy-remote: in the unlikely event of TrueAcre’s insolvency, escrow balances are not part of the company’s assets and are returned to the depositors. Interest accrued on escrow balances is retained by TrueAcre to offset operational costs.
§7Dispute resolution
If a dispute arises between buyer and seller, TrueAcre offers free mediation through a four-member panel comprising a retired sub-registrar, a senior legal partner, a TrueAcre verification officer, and a neutral observer. The panel’s findings are non-binding unless both parties opt into arbitration. Mediation typically resolves in 11 days for clear-cut cases.
If mediation fails, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Hyderabad, Telangana.
§8Prohibited use
You agree not to:
- List properties you do not have authority to sell.
- Provide falsified documents or forged identification.
- Solicit off-platform payments — all transactions must flow through TrueAcre Escrow.
- Use the Services for money laundering, tax evasion, or any illegal purpose.
- Harass, threaten, or defame other users.
- Scrape, mirror, or reproduce TrueAcre data without permission.
§9Liability
TrueAcre acts as a marketplace facilitator, not a party to the actual sale transaction. We are not the seller, buyer, or owner of any property. Our liability is limited to our specific buyer-protection guarantees set out in our Buyer Protection page, which include:
- Verified-document guarantee:refund up to the full purchase price if any “verified” document is falsified, within 12 months of close.
- Area guarantee: pro-rata refund if the surveyed area is more than 5% smaller than listed.
- Travel reimbursement: up to ₹ 5,000 if a property differs materially from the listing.
Beyond these explicit guarantees, our maximum aggregate liability to any user shall not exceed the total fees paid to TrueAcre by that user in the preceding 12 months.
§10Governing law
These Terms shall be governed by the laws of India. The courts at Hyderabad, Telangana shall have exclusive jurisdiction over any dispute not resolved through mediation or arbitration.
